S.M.ARTIST Official Global Fan club member Stipulation
All Services from S.M.ARTIST Official Global Fan club launch at the same time of the start of Official Global Fan club, the Valid term is ‘A year’ (hereinafter referred to as “Term”) since the official launching date, after joining and remitting the club dues. (the launching date will be informed by office.)

1. General Rules
1> Purpose
S.M.ARTIST Official Global Fan club (hereinafter referred to as Fan club) is organized with members who like S.M.ARTIST and purposes to share information about S.M.ARTIST and to support S.M.ARTIST.
「 Fan club 」divides into KOREA /CHINA /TAIWAN /THAILAND/HONGKONG /U.S.A/MALAYSIA/INTERNATIONAL, and other countries except for above are including to INTERNATIONAL. 「Fan club」stipulates member’s rights, duties and responsibility as below.
2> Members
i) This regulations (hereinafter referred to as「Regulations」 are applied to members(who will be define at clause 4.) every time they use the service offered by 「Fan club」. Members who joined to 「Fan club」are being considered as they agreed to this regulations.
ii) Notice to members at clause 3 and separately defined utilization of the services from this regulations(hereinafter referred to as 「Utilization」 are organizing a part of this regulations.
3> information of S.M.ARTIST
「Fan club」will notice information about TVXQ! will inform news which is related to S.M.ARTIST through an appropriate way like group mail, official website, mobile phone text and etc.
4> A Definition of Members
‘Members’ is that people who agree to this regulation and fill in the application and pay the club dues to 「Fan club」. The receive slip( or remittance receipt) has same power with Membership card if there is an activity as a member of「Fan club」before the Card is issued.
5> Assents of Joining
i) 「Fan club」is accepting applications on the basis of the joining standards and assents after having applications and club dues.
ii) If Parents of members object that their children joins to 「Fan club」, 「Fan club」 have a right to refuse the members’ joining to any official event and to not send official Goods to the members.
iii) if the applicants is judged as below, 「Fan club」can limit the members’ rights and postpone the approval of the application until the problem solves
(1) in case the application form hasn’t been filled in properly.
(2) in case club dues hasn’t been paid within 3days after applying the form.
(3) in case applicants remit over or short dues, not the correct dues.
(4) in case「Fan club」 judges to not be able to accept the applicant on their own standard.

6> The benefit of members
「Fan club」members are able to have the service as below.
(1) Membership Card of S.M.ARTIST’s New visual
(2) Joining 'S.M.ARTIST Official Global Fan Club「Fan club」Launching event' (Once A Term)
(3) Publishing S.M. ARTIST Official Global Fan club book. (Irregulary)
(4)「Fan club」Special Goods (Once A Term)
(5)「Fan club」Community activity and information ownership service (Coming Soon)
(6) Mobile Global Fan club Service (Coming Soon)
(7) Joining to Any Public program or event which S.M.ARTIST is joining. (Once compromised with auspices)
(8) Discount and joining to「Fan club」 Special movie sсript releasing. (with fee and Fan club will be preferred)
(9) Discount when buying Artist Goods at SM ON-Line mall ARTIST Goods. (Coming Soon)
(10) Joining to {「Fan club」Concert Tour}, Once S.M.ARTIST has a concert abroad.
(「Fan club」is not responsible for paying any expenses for the travel.
If there is excessive number of people, Since the number of participants is limited, 「Fan club」will draw lots.)

7> Club Dues
1. Applicants pay the Club Dues for newly joining to 「Fan club」 or prolonging their term as a member of 「Fan club」.
i) KOREA : 15,000 Korean Won (Korean, Foreign residents)
ii) CHINA, TAIWAN, THAILAND, HONGKONG, U.S.A, MALAYSIA, INTERNATIONAL
: 40,000 Korean Won (Korean who live overseas, Foreigner)
= 15,000 Korean Won (Club Dues) + 25,000 Korean Won {[Club Goods EMS Air Charge] + [Club Book Post Charge] + [Return Charge once no recipient is there.]}
2. Members can remit the Dues with their own name to 「Fan club」 account.
8> The term of validity
i) The term of Validity : A year since the date 「Fan club」 officially announced (the term will be informed later by「Fan club」. However, the term can be fixable by an unavoidable occasion ? e.g.)mailing Goods, S.M.ARTIST’s promotion activity.
ii) Special Goods from 「Fan club」 will be delivered only once per term. (overseas residents as well.) However, if there is any unavoidable occasion, it can be delivered after finishing the terms.
iii) If a member could not get the goods by their own fault, the member can receive the goods by paying expenses by themselves. But it’s possible only during the same term.
iv) After finishing the term, 「Fan club」will not resend any mail or goods which already sent to members.
9> The Duty of members
i) Members should manage their Membership Card, Number and Password under their responsibility. If there is any problem like usage by the 3rd person, 「Fan club」will not be responsible for that.
ii) Members can not lend, transfer the Card, Number and Password to the 3rd person.
iii) Once members change their information (e.g. name, address, telephone number, e-mail address, etc.), member can amend at the official website to avoid any disadvantage.
iv) If members could not get mail, notice because of their breach the regulation, 「Fan club」will not responsible for that.
10> Foreign Fan Club
i) Except for「Fan club」Korea, all foreign Fan Clubs are divided into KOREA /CHINA /TAIWAN /THAILAND/HONGKONG /U.S.A/MALAYSIA/INTERNATIONAL, foreign residents in Korea will be considered as「Fan club」Korea.
ii) Foreign fans’ joining process is same as the Clause 4.i. But the each division has their own application forms. The fans have to fill in the forms with designated language, and then have to remit the Dues to 「Fan club」account.
iii) Except for Foreign residents in Korea, the Dues (40,000 Korean Won) for Foreign Fan club include [Club Goods EMS Air Charge] + [Club Book Post Charge] + [Return Charge once no recipient is there.]
iv) All Foreign 「Fan club」are having same advantage as well as 「Fan club」 Korea.
11> Prohibitions
Members must not do as below at the same time of joining to 「Fan club」.
(1) All offers from 「Fan club」(e.g. Information, Sentences, Sounds, Visuals, Illusts - hereinafter referred to as [intellectual property]) cannot be copied, sold, published, air-played but for personal use.
(2) Taking photos and Filming of TVXQ! The acts which do no permission photographing from the public performance place and infringe a property and personal privacy or right of likeness.
(*All intellectual property right reverts in the S.M.ENTERTAINMENT. If any one violate this contract, they will be received a legal restraints and a punishment.)
(3) The conduct which damages the honor of the artist and the third party in criticism
(4) By a member benefit it is based to the qualification as the member card which is the possibility of getting, the ticket and the Goods back member and it depended to the Internet or by a different method me make the right which it will have, it monopolizes, transfer, lending and act of the back title transfer.
(5) Against the artist personal liaison or it meets exacting or apply the liaison or an interview to the artist at the company.
(6) The acts which use the Fan club and make a profit on「Fan club」activity for the personal sake. (As below make this as a 「business activity」
(7) The Fan club or makes a pretext the artist and the act which recruits the money or the commodity
(8) To the member of the Fan club or to the third party do a curses or a power of explosion the act which gives damage.
(9) The acts which use the Fan club and conduct Election campaign or perform any similar activity which violates a public position election law.
(10) The acts which use the Fan club for The religion act which includes the propaganda of the religion and the act regarding joining in the religious group.
(11) Other than the contents which it explains from above the act which it violates in law or good public order and custom disrupts the operation
(12) If violates other fan club member regulation and that the qualification maintenance as the member is impossibility, the case which the executive resolve (embezzles the personal information where is not the fact and the case which it uses)
12> secession
i) According to this「Fan club」contract, If a member of the Fan club committed any unreasonable behavior or breached an membership agreement, the membership status and all of the authority and The rights are eliminated automatically
ii) The member the case which hopes secession from the Fan club, it follows in demand of the member and it decides and the secession is possible within a limited period and must request in the Fan club.
iii) The case where the member will violate a 11th mourning preceding clause, the Fan club compulsion secession it will be able to manage to the corresponding member.
iv) Against the member seceding with option use of the membership fee, utilization fee of service, goods etc which already pays and the commodity back does not execute.
v) The member purchase charge and that outside of the goods back due to a member privilege use of Fan club service with the back against the payment duty occurring from point of view of secession a responsibility of payment even after seceding
2. MISCELLANEOUS
1> Service modification and standstill of service contents
i) According to the artist’s circumstances and operation situation, the part contents of member privilege and service of the Fan club will be able to change and standstill of provision will be able to discontinue.
ii) Fan club case of preceding clause3rd by chapter1 with the fact that against the member it executes a notice after the fact.
2> Dispersion
i) By the situation of that outside of activity situation of the artist it continues the operation of the Fan club, which, to the case which it will judge with the fact that it disperses.
ii) The case headquarters of a party of preceding clause against the member returning the membership fee back which payment is already over with the fact that it does not execute.
3> Handling personal information
Against the fact regarding handling of personal information of the member separate way it does with the fact that it follows in the rule which it decides and the Fan club member does with the fact that it follows to this.
4> Compensation
The member is related in use of Global and Fanclub the Fan club or the third party of that outside make against will compensate case this it will cause damage the responsibility which it falls.
5> Exemption from responsibility
It relates with the use of the Fan club and against the damage where the member gets the fact is confirmed the case where it excepts and never support any kinds of the responsibility.
6> the modification of the agreements
i) About the members the fact that it has modification, addition, it will amend and will be able to eliminate the contents of the rules which it sees without any notice
ii) Case of preceding clause 3 by chapter1 with the fact that against the member it executes a notice after the fact.
7> agenda
The fact which it does not provide from the rules which it sees or against the interpretation of the rules which it sees the case where the questionable matter will get, the member and the Fan club with the fact that it solves this after both discussion one.
8> inquiry
The member must confirm a common knowledge fact at any time and about lower the disadvantage which occurs does not bear responsibility with common knowledge unconfirmed. The common knowledge fact regarding the Fan club and line of inquiry do with afterwards together.

3. Third ? Artist Global Fanclub Co-Operators
1> Co-operators
As written on this contract Co-operator representing and leading members of “Fan club” , “Fan club” members are consist of people who able to managing and taking responsibility of all the fan club around the nation.
2> Co-operator Selection
Each year a representative(president of member),a vice president, and president of member from each nation will selected.
* How to become a Co-operator ? First we going to select people by going through all the resumes carefully, People who selected on resume, name will announced officially on the smtown.com, finally Co-operator will carefully selected by whoever get more point from president and co-operator whom came from same territory as candidates.
3>Duty and right of Co-operator
i) President of “Fan club” will have authority to control the members of “Fan club” and representative of members. As it is representative need to take command and collect opinions from each member.
ii) Co-operators are representing all 「Fan club」activities and will gather Member’s opinion through regular meeting and will run 「Fan club」in all territories with the president.
4> Co-operator regulation
As a Co-operator and representative of their nation obey and follow the regulation they signed
5> Term
i. Co-operator will start their duty right after their names are announced on Smtown homepage. Their responsibility and duty will need to carry out until we select new Co-operators.
ii. Co-operator
(1) Secession ? If more then half of the member agrees to secede that member can be dismissed
(2) Changing regulation ? If more then 70% of co-operator agrees to change the regulation.
(3) All contracts regarding to 「Fan club」are engaged by President of 「Fan club」.
(4) all miscellaneous will be judged by all situation’s flowing.
6> Seceding from position of co-operator
When a co-operator, wishes to secede from his/her position, will need to fill out contract paper clearly and announce it officially to all the members then he/she will forfeit eligibility.
7> Applicant of release of private information
“Fan club” inquired formally obey by law authority, Applicant private information can be released to public
8> Circumstances of “Fan club” agreement of ACT4 can be changed, A advance notice to applicant contents of regulation can be change, delete, appendix, adjustment can be made.
9> A subject of discussion
Provisions with missing subjects or if regulation that cannot be understood this regulation, members of “Fan club” and applicant , both parties will have mutual agreement to bring out the solution.
